ICE, the 5th Amendment and Habeas Corpus
Dear Editor,
It is disheartening to see Homeland Security ignore the illegal actions of their ICE agents during their immigration enforcement efforts.
Initially, the have ignored ICE following protocol for attire. All ICE agents must carry a badge and produce it upon request. Because of this lack of oversight we have seen many arrests in multiple states of individuals imitating ICE officers.
ICE has repeatedly ignored the Rule of Law by making arrests on Private Property and some cases arresting American Citizens. This issue has been addressed in multiple courts in multiple states. In each case the courts have ruled against ICE practices. ICE may not enter, detain or arrest anyone on private property without a Judicial Warrant.
Finally, ICE has ignored Due Process. Every inhabitant of the United States whether they are a Citizen or not, are entitled to Due Process. If these arrests are legitimate ICE should not fear the process.
As a retired Constitutional Law teacher I can no longer ignore these actions. The Administration has been sued multiple times and has lost in every case. Because of this the Administration is now threatening to suspend The Writ of Habeas Corpus. Habeas Corpus is a law that protects American Citizens from being illegally detained, arrested and transported to a foreign prison, like El Salvador. This alone should scare you. Contact your congressional members and tell them to stop capitulating to the administration.
I would encourage you to revisit the 5th amendment to the Constitution. Study the meaning of the Rule of Law, Due Process and the Writ of Habeas Corpus.
Some of you might find more clarity from the Bible. Specifically read, Exodus 12:49, Leviticus 24:22 and in the New Testament; Mathew 25:31-46.
